Terms of Service for MotionSeer

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of MotionSeer (the “App”), a motion detection security camera application. The App is available for download and use on iOS devices via the Apple App Store.
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not download, install, or use the App.
We may update these Terms from time to time. The updated version will include a new “Effective Date” at the top.
We do not send notifications about changes to these Terms, whether material or minor. It is your responsibility to periodically review these Terms for any updates. Your continued use of the App after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to use the App. If you are under the age required to consent to data processing in your jurisdiction, you must have your parent or legal guardian’s permission to use the App.
3. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use (or for legitimate personal security monitoring purposes).
This license is conditioned on your adherence to these Terms and all applicable laws. We reserve all rights not expressly granted.
4. Prohibited Uses
You agree not to:
- Use the App for any illegal, unauthorized, or harmful purpose.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Modify, adapt, translate, or create derivative works based on the App.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or related systems.
- Use automated means (e.g., bots, scripts) to access or use the App.
- Use the App in any way that violates the rights of others, including privacy or intellectual property rights.
- Share your live stream URL publicly or in a manner that could expose private feeds to unauthorized access (you are solely responsible for securing and managing your URLs).
- Use the App for commercial purposes without our express written permission.
Violation of these prohibitions may result in immediate termination of your access to the App and Pro features, without refund.
5. Subscriptions and In-App Purchases
The App offers a free version with basic features and a paid Pro subscription (the “Pro Subscription”) available through Apple’s in-app purchase system.
Pro Subscription Features
The Pro Subscription unlocks:
- People/person detection to reduce false alerts from non-human environmental motion.
- Support for iCloud backup of recorded video segments.
- Support for instant uploads of recorded video segments to your connected Google Drive account.
- Live streaming access from anywhere in the world via any browser or device by entering your secret URL (with single concurrent viewer limit and URL rotation capability).
- Device movement/shake/tilt detection mode to trigger alerts and recordings.
All payments for the Pro Subscription are processed exclusively through the Apple App Store using Apple’s in-app purchase system. We do not collect, store, or process payment information directly.
Subscriptions are auto-renewable unless canceled. Pricing, duration (e.g., monthly or yearly), and any trial periods (if offered) are displayed in the App and governed by Apple’s terms. You authorize Apple to charge your chosen payment method on file for renewals until canceled.
To manage, cancel, or request refunds for subscriptions:
- Use your device’s settings (Settings > [Your Name] > Subscriptions on iOS).
- Refer to Apple’s support resources for billing inquiries, cancellations, or refunds: https://support.apple.com/billing.
We do not handle subscription cancellations, refunds, or billing disputes directly—contact Apple for these matters.
We may change subscription features or introduce new pricing for future subscribers at any time. Any price increases for existing subscribers will be limited per Apple’s rules, with advance notice provided. Continued use after changes means you accept the updated terms.
6. User Responsibilities
- You are solely responsible for all content (videos, recordings) captured and stored using the App.
- You must comply with all applicable laws regarding surveillance, recording, privacy, and data protection (e.g., obtaining consent where required before recording people or audio).
- For live streaming: You are fully responsible for keeping your secret URL confidential. Sharing the URL is at your own risk; we provide no monitoring or access control beyond URL rotation.
- Enable features like iCloud or Google Drive at your own discretion—those services are governed by Apple’s and Google’s respective terms and privacy policies.
- Maintain the security of your device; we are not responsible for unauthorized access due to device compromise.
7. No Warranties; Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or reliability.
We do not warrant that the App will be uninterrupted, error-free, secure. Motion detection, person detection, alerts, recordings, backups, or live streaming may fail due to device limitations, environmental factors, network issues, or other reasons.
The App is not intended for life-safety, medical, or high-security applications. Do not rely on it as your sole security measure.
8. Limitation of Liability
To the maximum extent permitted by law, we (and our affiliates, officers, directors, employees, agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, even if advised of the possibility of such damages.
Our total liability shall not exceed the amount you paid for the Pro Subscription in the 12 months preceding the claim (or $50 if no payment was made).
This limitation applies to all claims, including contract, tort, strict liability, or otherwise.
9. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
10. Termination
We may terminate or suspend your access to the App or Pro features at any time, without notice or liability, for any reason, including violation of these Terms.
Upon termination, your license ends immediately, and you must cease using the App. Pro Subscription features will no longer be accessible (though you may retain locally stored videos).
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the European Union and any disputes shall be subject to the exclusive jurisdiction of its courts.
12. Miscellaneous
- Entire Agreement: These Terms (together with our Privacy Policy) constitute the entire agreement between you and us.
- Severability: If any provision is held invalid, the remainder remains in effect.
- No Waiver: Failure to enforce any right does not waive it.
- Assignment: We may assign these Terms; you may not without our consent.
- Third-Party Beneficiaries: Apple is a third-party beneficiary regarding in-app purchases and may enforce these Terms against you.
